ONE of the biggest Islamic schools in Australia will be built in south-western Sydney after Bankstown City Council lost an appeal in the Land and Environment Court.

The decision will allow construction of a 1200-student primary and secondary school in Bass Hill, which has been fought by residents since the land was bought in 2006.

It is one of several applications for Islamic schools that have divided communities in NSW, leading to allegations that residents are using town planning arguments such as traffic to cloak racist sentiment.

Bankstown council first knocked back the proposal in 2007 after residents launched a campaign opposing the project.

The group behind the school, Al Amanah College, appealed against this decision. Last December, Senior Commissioner John Roseth of the court approved the plan to build the school on a 18,000 square metre site at Johnston Road. A child-care centre is also proposed.

Finding for the school, the senior commissioner addressed concerns raised by the council, including traffic flow, noise, ecology, the scale and design of the buildings and its social impact.

The judgement also referred to "the elephant in the courtroom" or "whether the council would have raised quite as many contentions as it did if the application had been for an Anglican school".

At the time, Mayor Tania Mihailuk ruled out a further appeal. But after lobbying from residents and legal advice indicating there had been an error of law, the council lodged a section 56 appeal.

This was an internal appeal from a commissioner to a judge on the basis that the initial decision contained a mistake in the way that the law was applied.

The council's legal team argued that Senior Commissioner Roseth had failed to take into account relevant provisions of the local environmental plan, including whether the development was compatible with the character of the area.

In dismissing the appeal, Justice Peter Biscoe found that the commissioner had considered the arguments raised by council and found against it on all counts.

The fact the commissioner did not refer to specific planning clauses in his judgment did not mean he had failed to take them into account, the judge said.

"In my opinion, having regard to the way the case was presented to him, the Senior Commissioner did not make any error of law, let alone an error of law that would justify intervention on appeal," Justice Biscoe wrote in his judgment, handed down on Monday.

The court dismissed the appeal and awarded costs against the council.

A spokeswoman said the council was disappointed with the decision. "We will now be working to ensure that the development of the site does not create unnecessary impact on neighbouring residents and that the conditions of the court's consent are strictly followed."

The principal of the Al Amanah College, Mohamad El Dana, said yesterday: "We are very pleased with the decision because we feel like justice has been achieved. There is no reason for any fear. We will be working for the benefit of the community as a whole."

In a separate case before the court, a Muslim group has appealed against Camden Council's decision to refuse its application to build a $19 million Islamic school for 900 students. A decision is expected in that case within weeks.

还好啦,不说众多基督/天主等教会学校,
墨尔本不是还有几所犹太学校专门只收犹太人的,每次VCE还都名列前茅....
如果偶们华人有人愿意办的,也有家长愿意送的话,估计也办得起来。

我个人理解,
这件事其实我们也可以积极正面的来看,
比如,
按照一般的理解,
澳洲本地人“极其不喜欢”穆斯林,
“非常不喜欢“黑人,
“不喜欢”华人,
“不喜欢”印度人。。。
在这样的社会氛围下,澳洲的政府部门还是有很大的容忍度来包容其实他们自己并不喜欢的东西,依法办事,按包容多元文化的精神来看待这件事。
澳洲政府能容的下穆斯林,就能容的下我们华人和其他少数民族的人。
这个和民间观感是两码事。
这样想想,其实是说明政府还是很“正常的”,呵呵。

但是在现行教育体系外建立专门的伊斯兰学校,不知道是不是大纲一样,只是加多了伊斯兰宗教部分?

这样的宗教教育能教育出对澳洲社会有益的人来吗?
我们只能寄希望于那些悉尼的阿訇不是原教旨主义者。
否则就跟伦敦一样,那里的宗教学校不少。

这样多好啊, 你们真是有所不知了, 因为学校是他们小孩读书的地方,把他们小孩聚在一起, 然后在他们学校地下埋点毒药,屎呀, 铀矿呀啥的, 让他们集中在一起生病, 禽流感, SARS什么的

以前玩红警的时候就是喜欢玩到最后, 把敌人集中在一起, 然后乱炮扫射, 最后还整个原子弹

State Government to oppose Islamic college

THE NSW Government will oppose the building of a highly contentious Muslim college next door to a state high school in Sydney's west.

Education Minister John Della Bosca yesterday said the development proposal would be opposed on planning grounds when it came before Bankstown City Council for approval.

The NSW Government has been criticised for failing to block the sale of public school land to the proponents of the religious school, Al Amanah Islamic College.

The land was part of Bass Hill High School. The Education Department sold the land to a buyer believed to be a housing developer. However, this developer sold the land to the backers of the Islamic primary and high school for the site.

Nearly 800 residents yesterday gathered at Bass Hill High School to rally against the Muslim school, which has been described by opponents as greatly increasing sectarian and social tensions particularly among children. State member for Bankstown Tony Stewart told the meeting about the Government's intention to oppose the development before the council.

Mr Della Bosca said the Government was very unhappy that the transaction appeared to be a breach of protocol. He said either the Department of Education or the school would lodge its formal opposition to the proposal on planning issues, including traffic congestion and amenities.

"We have undertaken to object and that's what we will be doing," he said. "There is a whole range of planning issues. They're the only things at issue."

Mr Della Bosca did not believe the Government erred with the sale, despite Mr Stewart saying the Department of Education had failed to "dot their i's and cross their t's" over the sale.

"That was a decision made at the time of the previous minister," Mr Della Bosca said.

"I don't think that's an error."

Residents action group chairman Vern Falconer told the gathering that the main problem with the school was parking and traffic congestion. He urged the crowd to restrain mounting racial tensions arising over the development.

A representative of the Muslim community believed to be linked to the developers of the school said plans for the site involved only a school and not a broader convention centre.

He said that local Muslim parents needed an Islamic school for the Bankstown area and that the school wanted to build bridges with the neighbourhood and the wider community.

The meeting was interrupted by a few protesters who claimed opposition to the development was based on religious and racial grounds.

A man of Middle Eastern appearance who was videotaping the meeting was criticised by Mr Falconer from the stage. Mr Falconer's comments drew cheers from the crowd.

Outside the meeting the man, who did not wish to be named, said he was a local resident and had concerns about racist attacks.

A spokeswoman for Bankstown Council said the development proposal would be on public display this week.

Green light given for Islamic school at Bass Hill

THE land on which an Islamic school is to be built in Sydney's south-west was obtained by deception so the state's education minister should take it back, the NSW Greens say.

The Land and Environment Court (LEC) gave conditional approval on Thursday for a 1,200-student Islamic school to be built, despite the controversial plan having been rejected twice by Bankstown Council.

NSW Greens MP John Kaye said the first problem was that the college would generate a lot of traffic and have a severe impact on residential streets.

"The second is the land was obtained by deception. The government was told it was going to be a residential development, Garden View Apartments was purchasing the property,'' Dr Kaye told the ABC.

"When they first signed the contract for sale, it was signed to a company called Garden View Apartments with the understanding that it would be developed as apartments, as the name would imply.

"Just before the contract was finalised, Garden View Apartments exercised their right to change the name of the purchaser and they changed it to al-Amanah College.''

At that point the government made a massive mistake, Dr Kaye said.

"The government should have said, 'No, wait a minute, we're not going to sign the final contract ... it's very clear the government was concerned about it, people within the Department of Education became concerned about it.

"But they panicked and went ahead and signed ... which meant basically they were in trouble.''

Dr Kaye urged Education Minister Verity Firth to use her powers to obtain the land, so it could be used for public schools.

"What we shouldn't do here is be distracted by the racist climate. We shouldn't be distracted from good policy by the idea there may be some people who oppose it because of the environment.

"As soon as possible, Minister Firth needs to exercise her powers under section 125 and resume the land, and then after question, well if there's demand for 1,200 students let's build a public education facility there that copes with that number of students.''

The LEC will next consider the development on December 19.

Principal Mohamad El Dana said the group would make minor planning changes requested by the court and expects full approval by December 19, with stage one - a kindergarten to Year 6 school - opening in 2011.

"We went through hardship with the community but that is in the past," Mr El Dana said. "We're looking for better relations with . . . the community."

The original proposal submitted to Bankstown Council last year drew 1300 objections and heated community rallies attended by hundreds.

Handing down his decision, Senior Commissioner John Roseth questioned to what extent those objections were racially motivated.

It is an accusation Bass Hill and Georges Hall Resident Action Group member Peter Driessen says has "upset" the community. "We made a decision early on that race would not be a motivation," Mr Driessen said.

The main objections were about over-development of the site and that the school was beside Bass Hill High School, increasing traffic congestion and noise problems.

Resident Osi Khoury said she already dropped 14-year-old Yulita and 12-year-old Noel at the high school 20 minutes early to avoid the rush.

"Everyone in the neighbourhood is against the school for traffic reasons," she said. "Can you imagine every parent dropping off one or two kids; it's going to triple the amount of traffic.

"It is has got nothing to do with it being Muslim. I have many Muslim friends. Had it been a Catholic school, everyone would have been against it."

Bankstown Council will not appeal against the decision but some residents have vowed to continue the fight.
