We are aware that since the release in January this year of the public discussion paper on the
Business Skills visa program by the Australian Department of Immigration and Citizenship to
canvass the view of interested stakeholders, there has been much speculation among the
migration consulting industry operating in this region on the future look of the program.
There have been promotional seminars organised by agents and newspaper articles published
quoting these agents on their assumptions of what changes to the Business Skills visa program
are likely to take place. These were to a large extent engineered with a view to recruit
prospective clients as they invariably lead to the same conclusion that in order to avoid the
purported tightening of entry requirements, those who are interested in the Business Skills
visa program should sign up to lodge an application before 30 June this year.
It is important to note that there is no definite time frame or set agenda for any change that
might result from the consultation process. It is simply not true that radical changes will be
made to the Australian Business visa program from July 2011 or that a points test will be
introduced then to measure applicants on various attributes.
For migration agents who are registered with the Migration Agents Registration Authority,
participation in such false or misleading advertising may be found in breach of the migration
agent’s code of conduct. This office has taken action to bring this matter and particular agents’
behaviour to the attention of the registration authority.
