I refer to your letter of ...
The pictures attached to your letter make it clear that your client does not place value on the dilapidated timber fence on the boundary. She had this boundary shielded by a dirty, weathered board for about ten years before it blew over in the wind, and then tried to blame me for that. The clear inference of which is that the old fence is of no va lue to her.
The only practical effect of rebuilding a cheap wooden fence ten centimetres alongside my superior quality and taller brushwood fence would be to create a vermin and weed trap. Such a fence would make it impossible to control grass and plants growing in that ten centimetre channel. Your client has also said that she would require me to clean this space in future.
Your client's insistence on creating this channel trap ignores my clear-cut explanation of how the Dividing Fences Act 1991 {NSW} applies to this case. That explanation was provided in my letter of 30 July 2019, but since your client has not acknowledged it, I hereby provide material sections of the Act:

The requirements of this Act will be satisfied by keeping the current brushwood fence about ten centimetres inside the boundary of my property. The Dividing Fences Act 1991 {NSW} does not give priority to older fences or to rebuilding them, as your client continues to pretend.
Regarding the palm trees, legally, your client is required to deal with fallen fronds herself or return them to me in a safe, convenient manner, not as she did in early 2019 when she decided to throw debris which had accumulated over many years over the fence at the one time, yelling at me.

confirm my offer in which I will:
1. Remove the old, damaged ten-metre timber fence alongside the bamboo
2. Remove bamboo growth under and alongside that ten-metre length
3. Dig a trench 600mm deep along that ten-metre length
4. Fill the trench with Permathene root barrier and sand so that the bamboo cannot grow in the space between my brush fence and the boundary.
I will continue to maintain my palm trees but will not be responsible for maintaining your client's garden; she will have to learn to be diligent to keep her garden tidy in future. She can replace the old timber fence on the boundary at her expense but will have to clean it as it will create a vermin and vegetation trap.
