david chen ,请问一下交了5700多的税,税前收入37000多。就是一般的employment 没有任何投资,和deduct.大概能退回多少,顺便说一下要交medicare levy 的,听说只退回几百块

Re: Investment allowance for small business, suppose I buy a car worth $30k in June 09 and am eligible for the 50% bonus deduction, I can claim immediate deduction of $15k in 08-09 tax return.  Assuming my marginal tax rate is 30%, I can then reduce tax payable by $4500.  Suppose that I sell the car in August 09 at $28k, I will still be better off by $2500 ($4500-$2000).  Won't this tax break then turn into a scheme?  Or is there some holding period or other eligibility criterias that the business must satisy?  Thanks!!

there is no holding period requirement as far as i know, is it a scheme? it definitely sounds like one the way you said it. However, i believe you have used some very favourable numbers, i cant say that the real saving will be as much as what you hope for.

main residence exemption - lifetime but general rule is only one residence at a time (there are exceptions, for example,
118-140  Changing main residences
        (1)        If you *acquire an *ownership interest in a *dwelling that is to become your main residence and you still have your ownership interest in your existing main residence, both dwellings are treated as your main residence for the shorter of:
        (a)        6 months ending when your ownership interest in your existing main residence ends; or
        (b)        the period between the acquisition of the new ownership interest and the time when the ownership interest referred to in paragraph (a) ends.
        (2)        Subsection (1) only applies if:
        (a)        your existing main residence was your main residence for a continuous period of at least 3 months in the 12 months ending when your ownership interest in it ends; and
        (b)        your existing main residence was not used for the *purpose of producing assessable income in any part of that 12 month period when it was not your main residence.

Hello, if an individual rents out part of the property he rents i.e tenant becomes second landlord, can he claim repair deductions for works carried out? I guess the cost must then be apportioned? Thanks.

repairs can be claimed if it is in relation to earning the rent. however, artcore is correct, is the person declaring those income in the first place?

it is a bit of stretch for tellers to do master of accounting, will you get a payrise or promotion after completion of the course? is it recommended by the bank you work for, if yes, then you are more likely to be eligible for the deduction.

You can only claim self-education expenses that related to your work as an employee at the time you were studying. If your self-education was to help you get a new job or commence a new income-earning activity, you cannot claim your expenses.

我报过这个。但我的情形是,200x年11月我找到一份accountant工作,这个时候我Master of Accounting的其中一个学期已经结束了,我不能claim这个学费作为self-education,200x+1年的第一学期的学费我就能claim了,因为我已经找到accountant工作,并且我可以选择中止学业,因此,我可以argue我继续学业并不是为了延续之前的学习,而是为了更好的完成本职工作,so it is not capital spending, it's self-education expense, which closely relating to my current job responsibility.

claim税的关键就是你有没有reasonable arguable position. 去年我连BRW杂志的订阅费也claim了,因为CA/CPA在上面做广告,说明这个杂志是closely relating to the accountant professional body and relevant professional memebers or associates.

thank you qqyang, the issue here is the timing of the expense, if the course was entered into before commencing relevant employment, then the expenses are not deductible, they were incurred a point too soon however, if you incurred expenses while working, and you are eligible for the deductions e.g. (you incurred expenses so you can improve your skill at work/get a payrise etc) in that case, you can claim deductions. Therefore, i do agree with qqyang's view. However, as well as having a 'arguable position ' use tax rulings and ATO released examples to support your claims, the relevant tax ruling for this is TR98/9 if you are interested

Thanks for sharing; my case is a little bit difference. I’m holding the student visa now. The course I enrolled is Master of Accounting with CPA Extension, which is consisting of two parts: diploma of accounting and CPA Program.  I found an assistant accountant job before I started the CPA Program (Part time during study and full time during uni. Break). I could argue that the aim of CPA Program for me is to improve my professional skill at current position. Most of my job is related to month reporting, budget, forecasting and cash flow etc. Therefore, the CPA program strongly supports me during my working in the past years. If it doesn't work at the public ruling, I’m going to apply a private ruling coz a big money would be claimed back. Any suggestion would be appreciated.

Hi David, one of my friends wants to claim Fashion Magazine for about $2500, he is a fashion designer and his annual income is about 130,000 before tax. Do you think that's claimable? All receipts kept and the magazines are all about fashion which is the industry he is working in. Thank you.

Yes, i can't see any reason why he can't claim the expense, tax payers can claim immediate deduction for work-related journals, periodicals and magazines that have a content specifically related to their employment.

But do you think it is necessary to portion the amount by pages which contains other irrelevant content such as furnitures and Ads?
Because he went to a tax agent and the agent is reluctant to claim this expense, I think, because of its large amount.

i don't believe it is necessary to do an apportionment, and it will be very difficult to do apportion based on page contents (and almost unheard of). Having significant work related deductions may make your return stand out when compared to others in the same profession, however, this should not deter you from claiming eligible deductions. I'd recommend your friend speak to the tax agent again, and possible bring the magazine alone, so he can explain how the content relates to his work.
Besides the amount involved, did the agent mention any other reasons why he is reluctant to claim the deduction?
