It doesn't work in that way. The main residence exemption is not reduced if part of a taxpayer's dwelling is used by someone else, eg another family member. So if you let your parents or in laws live in your house, you wont lose the main residence exemption。 But you can't declare more than one main residence at the same time, not to mention that you don't live in the other unit/house, which is your parents' place. So if it's anyone's main residence, it's your parents', for tax purpose.
So we are back to the starting point again. Whether you can get the mortgage approved depends on the your borrowing power.
About the other question. ATO runs data match with real estate agencies. The ATO also has access to the Office of state reveue, but seems they don't data match in that way. Too many parents let their kids live in their investment properties for free. The ATO only has limited resources. When they strike, they won't walk away with small potatos. |
