车祸遇难司机其实死于枪伤，警方起诉业主过失杀人罪名

警方指称，21岁男子驾车离开这处产业时，被业主开枪打中了。

业主的律师说，因为产业多次被人闯入，业主一直把枪放在枕头底下。

虽然警方发对保释，但是法官准许了。

3月21日一名男子死于Kingaroy 附近的Booie，昆州警方调查之后，起诉了一名男子过失杀人罪名。

初期的调查认为21岁、家住Nanango 的男子死于车祸：汽车在Kingaroy Barkers Creek Road 某私家产业上撞上栅栏柱子，导致他伤势危重而死。

但是，后来查明他的死因是一处枪伤。

警方说，他在当晚11：30左右就驾驶2005年现代Sonata 抵达了该处产业。

警方找到他时，他被困在汽车里，昏迷不醒。

昆州救护车急救员做了抢救，然后把他送去了Kingaroy 医院。后来他在医院去世。

在警方和救护车到场前，车里的男乘客就逃离了。

警方组建了“Whiskey Quinta”调查此案。调查的结果，警方起诉了38岁、家住Kingaroy 的男子1项过失杀人和1项保管武器不善罪名。

他被警方拒绝了保释，4月3日过堂。

调查还在继续。

(1) A person is not criminally responsible for an offence if he or she carries out the conduct constituting the offence in self- defence.

(2) A person carries out conduct in self-defence if and only if he or she believes the conduct is necessary:

(a) to defend himself or herself or another person; or
(b) to prevent or terminate the unlawful imprisonment of himself or herself or another person; or
(c) to protect property from unlawful appropriation, destruction, damage or interference; or
(d) to prevent criminal trespass to any land or premises; or
(e) to remove from any land or premises a person who is committing criminal trespass;
and the conduct is a reasonable response in the circumstances as he or she perceives them.

(3) This section does not apply if the person uses force that involves the intentional infliction of death or really serious injury:

(a) to protect property; or
(b) to prevent criminal trespass; or
(c) to remove a person who is committing criminal trespass.

(4) This section does not apply if:

(a) the person is responding to lawful conduct; and
(b) he or she knew that the conduct was lawful.
However, conduct is not lawful merely because the person carrying it out is not criminally responsible for it.

可惜澳洲没有城堡法，也不能使用枪支自卫，所以过失杀人基本上逃不了，但是律师给力的话可以判为故意伤人。因为屋主并没有开枪打死对方，对方是逃离时驾车自己车祸死亡。不管怎么说，屋主至少除了一害。

业主紧急情况下当时的判断是此人要开车去寻找帮手，开枪是防止自身进一步受伤害

房主失策了，应该在他们进入时就开枪，人跑了你再追上去来一枪，这就犯法了。

Mr McGuire said thieves broke into a shed in August last year and stole equipment.

The court heard Mr Pates had found two people breaking into a vehicle on his property shortly before midnight on March 21 this year and that the car then came at him.

Mr McGuire told the court, police were called to the property where they found Mr Pates and his wife in a stressed state.

Sergeant Barry Stevens told the court Mr Pates had fired the shot after the vehicle passed him.

He said Mr Pates had also dismantled a CCTV system on the property and only provided it to police later, on the advice of his lawyers.
