这还是第一次听说这规矩

今日收到传票
获知法庭

旋即打电话至法庭预约翻译
要求提前一周再次致电确认翻译

之后致电LawAccess NSW 1300888529
大致说明情况后给了家附近的一家提供免费咨询的律所

致电律所后
预约了下周四晚上7点面谈
律所也帮我预约了翻译

所以现在需要准备的就是文字材料

如果运气好的话
我希望的品格证明人可以在出庭前返回澳洲
就更加完美了

今天上午上庭
由值班律师代理
我在法庭里面所做的就是起立两次
鞠躬一个

在找值班律师前
为了表现认错态度良好
先认了罪

不过后来律师分析结果应该是不认罪

因为
警察开罚单理由是P牌开了high performance车
而事后申请到的豁免信证明了这车并不是high performance车

所以我的错误在于
在车子有可能是high performance车的情况下
没有主动先申请豁免消除误会

但是律师认为我并不是具备专业知识判断车辆是否属于被禁止的high performance车

果然
上庭时
律师大概就说了两分钟
法官说的时间还长点儿
像喃喃自语一般

主要就是
1，我能感觉的小茉莉你收到罚单以后有多震惊，开罚单一周后就申请到了豁免信
2，现在好多车出厂的原厂配置就是带turbo引擎的
3，这个案子结案，罚款扣分全部免除
4，Unfortunately 小茉莉你还是把庭审费缴了吧

老实说，听见法官说Unfortunately 的时候，我内心那个暖流啊。真想抱着法官亲亲。花81法院一日游太值了。不过可惜过程太快。9点排队过安检进法院。10点就到家追潜行狙击了……中间还排了一会儿队缴费，排到了才说：你回家等信吧，系统里还没更呢……

这个不影响无罪的。这个规定不知道，如果红p不能开大排量的车，看不到有啥理由可以免。

家庭唯一用车肯定是不行的，如果你家里只有个坦克呢？
只能是良好记录，然后找点客观事实，比如平时都是老公开，不知道这个车是大排量的等等。

Licence restrictions for P1 driver licences

Automatic transmission vehicles – You are restricted to driving an automatic or clutchless manual transmission vehicle if tested in one.
Zero Blood Alcohol Concentration (BAC) – You cannot have any alcohol in your system when you drive a vehicle.
Demerit points – If you incur 4 or more demerit points during the term of your licence, action will be taken to suspend the licence.  Note that demerit points may carry over to your P2 licence.
Display of P plates – P plates (red P on a white background) must be clearly displayed on the front and back of the vehicle.
Licence class – You can only drive cars and/or motorcycles.
Passengers – The one passenger condition applies to provisional licence holders disqualified for a driving offence. After the disqualification period, you will be restricted to carrying no more than one passenger at all times while driving, for 12 months.
Seatbelts – You must ensure all occupants, including yourself, are in a seat that has a seatbelt or an approved restraint fitted and that each passenger is using the seatbelt or restraint.
Speed limit – You must not drive faster than 90 km/h and must observe the speed limit where it is below 90 km/h.
Supervising a learner – You must not supervise a learner driver.
Towing – You are allowed to tow light trailers up to 250 kilograms unloaded weight.

Vehicles – You must not drive any vehicle with:
Eight or more cylinders (except Diesel).
A turbocharged or supercharged engine (diesel powered engines exempt).
Modifications that increase engine performance.
Any other vehicle identified by the RTA – further details available on the RTA website.
Please note exemptions may apply.
In addition to the above, the following restrictions apply from 1 July 2007:

Display of P plates – P plates (red P on white background) must be clearly displayed on the front and back of the outside of the vehicle. The letter P on the plate must not be hidden.
Mobile phones – You must not use a mobile phone while driving or while your vehicle is moving or is stopped but not parked. This includes phones in the hands-free mode or with the loudspeaker operating.
Peer-Passenger – If you are under the age of 25 you must not drive with more than one passenger under the age of 21 between the hours of 11pm and 5am.Licence suspension for speeding – Your licence will be suspended for at least three months for any speeding offence.

不影响，offence是违法/违章，政府那个要求的是无"犯罪“，即不触犯刑法。

叔叔刚才问我多大排量
我说我不知道
估计他觉得我狡猾狡猾滴
自己开引擎盖查了
也不说告诉我一声

红P不能开大车我听说过
但是不是25岁以下吗

理解，但是路局的规定还是要遵守，不然被罚也没办法，虽然有些规定很傻，比如你的车，如果L牌就可以开，拿了红P反而不能开。

看我帖的红字部分，跟排量无关，有关系的是是否turbocharge/supercharge, 以及气缸数。（NSW省规定）
25岁以下，影响的是夜间带乘员，与开什么车无关。

交规上有写着的，L/P 不能开大排量的车。我正在学习，后天考试。

我又多一条可以陈情

真不明白为什么男的都喜欢大鼻子

s-edition 啊！大马力的turbo啊。P肯定不能开，和年龄无关。不想继续挑衅警察，就换别的车开吧。见一次抓一次。rta网站有明确说明的。

另外啊，一般自己觉得车技好的人，开车都不咋地。。。lz规矩都没搞明白，红P就开个大马力的上街招摇，这不是跟自己过不去吗。

An exemption from the prohibited vehicle condition may be granted if:

A prohibited vehicle needs to be driven for genuine employment purposes.
Eight or more cylinder 4WD vehicles are required by country drivers who have no practical alternative.
You can prove direct ownership of a prohibited vehicle prior to the start of the scheme or before an overseas/interstate licence transfer.
The vehicle is a moderate-performance turbo/supercharged engine vehicle.
Note: NSW provisional licences issued prior to 11 July 2005 were not conditioned. However, the condition will be applied if the provisional driver is disqualified for an offence committed on or after 11 July 2005. In these instances, the provisional holder may be granted an exemption if they can prove direct ownership of their current vehicle at the time of the offence that led to the disqualification.

Examples of moderate performance turbo/supercharged vehicles that are eligible for exemption include:

Alfa Romeo 1368cc Giulietta
Audi 1197cc and 1390cc (90kW) A1
Audi 1390cc A3
Audi 1798cc A3 and A4
Audi 1984cc Q5
Citroen 1598cc C4 1.6L
Fiat 1368cc, Punto and Rimto
Holden 1400cc Cruze
Mercedes-Benz 1796cc CLK200K, E200K, C200, CLC200, C230 and SLK 200K
Peugeot 1598cc 308 Series 1.6T XSE
Saab 1988cc 9-3 Linear, and Vector
Skoda 1798cc Superb 1.8 TFSI and Octavia 1.8 TFSI
Volkswagen 1390cc Golf 90TSI and Golf 118TSI
Volkswagen 1984cc Tiguan 125TSI and Passat 147TSI
Volkswagen 1197cc Polo 77TSI
Note, for enforcement purposes provisional drivers must carry an exemption letter from the RTA to drive these vehicles.

Please note that even if the vehicle is classified as a moderate performance vehicle, the vehicle is still regarded as a prohibited vehicle and an exemption to drive the vehicle must be approved and obtained from the RTA before the holder of a provisional licence is able to drive the vehicle. .

另外，跟排量，车体大小，是否大鼻子无关，要求是不能开手动档（除非是换档拨片的那种而且路考时使用手动档车），不能8缸以上发动机，不能有涡轮增压或者机械增压，除非是柴油车（因为柴油多数是涡轮增压）。
