开发商要要延长Sunset date, 大家遇到过吗

前几年,我交了好6.5万首付款(5%),在最高点的时候买了一套位于西北 Marsden Park 的 off-plan(地块房)。开发商是印度的 Bathla。

一直都拖着没有注册土地, 合同上的Sunset Date 是 31/12/2024.

这两天收到对方发来的邮件。
We refer to your clients purchase of  Proposed Lot xxxxxxxxx, Marsden Park .

The Vendor hereby gives notice in accordance with special condition 46 of the Contract for sale that the Sunset Date is to be extended to 31/03/2025.

Specifically, the vendor relies upon special condition 46.3 in that:
  • The vendor miscalculated the time required to complete construction; and
  • The vendor’s financier requires the sunset date to be extended as a condition of its funding approval.

The 2 reasons given by you are not related to Special Condition 46.3 in the Contract. We do not agree with the extended Sunset date.

对方回复
Pursuant to special condition 46 we advise that development works have been delayed and we hereby extend the registration date to 31 March 2025.

我看了看合同。。


这两个理由好像不太符合合同。对方计算错误,这是他们的责任,他们的金融机构不给批准,这是他们之间的私人协议,

我已经付了 6.5 万,还拖了我这么多年。我自己的贷款一直在支付高利息,现在又被拖延。

大家有没有遇到过类似的情况?这种情况该怎么处理

新洲政府的法律开发商是可以连续多次延期Sunset date, 没有截至日期的话,这不是可以一直拖下去了, Sunset date的意义又何在呢。
