无故被殴致死的41岁墨尔本维多利亚大学华裔数学研究员曹中军博士遗照



2009年8月12日澳联社报道,今天上午,维州最高法院对杀害维大华裔研究员曹中军博士的从犯做出判决,这名法律禁止披露姓名的17岁青少年M被判处10年零6个月监禁,不过6年后即可申请保释。判决书中显示,这名少年当时把曹博士抱住并举起来,头朝下撞击地面。

7月29日,维州最高法院主审法官David Harper判处杀害曹博士的21岁主犯John Caratozzolo入狱15年,前10年不得保释。呈堂证供显示,该被告在曹中军被击倒在地上之后,对其头部猛踢一脚。

今天宣判时,David Harper法官也对来自澳洲社会和媒体对该案判决的广泛质疑和批评作出辩护,他一再表示这两名罪犯都没有故意杀害曹博士的意图,媒体的报道属于误导澳洲民众。




不过,曹博士的亲友对David Harper法官的辩解无法认同并表示愤怒。曹家的友人李博士(Dr Wellington Lee)表示,判决根本没有反应公众的预期。“一条命值多少钱?对于这样野蛮的图财害命行为,判决太轻太不足够,向更广泛的社区发出了错误的信号。看看如今的墨尔本治安状况,社会渣滓到处横行。而曹中军博士的遗孀和幼女以及亲友却被判了“无期徒刑”:妻子没有了丈夫,女儿没有了父亲!”

另一名曹博士的亲友刘保罗(Paul Liu)表示,“澳洲普通老百姓的安全应当受到保障。一个稍微有点脑子的人都会明白举起一个人,并将他头朝下撞击地面的行为会死人,即使12岁大的小孩子也会明白这个道理,怎么能说没有杀人意图?” “这些罪犯太容易逃脱法律的严惩了,我对公众在街上安全行走感到更担忧了,我对我们的下一代的安全表示忧虑。”

据统计,在过去5年判决的129个谋杀犯中,只有5人的判决低于杀害曹中军的主犯,有8人的量刑和其相当,即10年的不可假释期。在这些谋杀案判决中,平均的不可假释期是16年。








Teen jailed for six years over bashing death of Cao Zhongjun

UPDATE 12.58pm: THE family of a man kicked to death for fun says the jail term given to a teenage gang member is inadequate.
The youth, who cannot be named for legal reasons, was sentenced to 10 years' and six months jail, with a minimum of six years before being eligible for parole.

“It’s the equivalent to a rap over the knuckles,” family friend Dr Wellington Lee said outside the Supreme Court today.

The teenager helped beat university researcher Dr Cao Zhongjun to death in Footscray in January last year.

The youth, had pleaded guilty to murder and robbery, over the death of Dr Cao, 41.

In sentencing, Justice David Harper defended the jail term saying there had been no intent to kill.

He also criticised media reporting of the case, saying suggestions the jail terms of other gang members were inadequate was misleading.

“In my sentencing remarks (of sentence given to gang ringleader John Caratozzolo last month) I referred once to s.3A and twice to the fact that Caratozzolo did not intend to kill,” he said.

“This circumstance was a factor material to any proper consideration of the sentence.

“The public therefore had a right to know about it.

“Some media, however, failed to disclose that important information.

“Accordingly, reporting of the sentence was to that extent seriously deficient.”

But furious family friends said outside the court that the sentence was not in line with community expectations.

Dr Lee said it did not send a strong enough message.

“When do we get a law that serves justice and not just the law,” he said.

“We’ve got to protect the safety of our citizens and we’re not doing that, we’re not sending a strong enough message.

“Look at what’s happening in Melbourne at the moment, thugs get away with everything.

“What they’ve done now is sentence Mrs Cao and her daughter and their relatives to a life sentence, they’ve got to live without their father, live without a husband.

"The sentence is quite inadequate, I heard his (Justice Harper) explanation, but I still don’t think it’s adequate.”

The court heard the teenager and the gang decided on January 22 last year to find an Indian student and steal their mobile phone.

Instead, the gang came across Dr Cao.

"You lifted Dr Cao off his feet and then dropped him,'' Justice David Harper said in sentencing the teenager today.

He said the youth then told Dr Cao to bend over, before stealing a mobile phone from the victim's pocket.

Another gang member, 21-year-old John Caratozzolo of Melton South, then kicked Dr Cao in the head.

Justice Harper sentenced Caratozzolo, the attack's ringleader, last month to 15 years with a minimum of 10.

Another family friend Paul Liu said the public should be assured of their safety.

“A person with any brain (would understand) if you lift someone upside down and put their head first on to the ground, that will kill.. Even a 12-year-old kid would know that,” he said.

“People get away with it too easily, I’m more worried about the general public who should be able to walk safe on the streets.

“I worry about the future generations’ safety, their right to live.”

做个无聊的假设,如果曹博士的朋友或者家人想为他报仇。找到这个法官的家人,然后用同样的方式把他家人抱起然后头冲地。然后自己去自首。那看这个法官又是如何判呢?反正就算杀死也不用死的。

本人英语功底差,从判词看,检控方并没有指控"故意杀人",因此法官无法判"故意杀人",也不能用"故意杀人"的量刑

28 One such matter is that the Director of Public Prosecutions did not allege, and Caratozzolo was therefore not sentenced on the basis that, he intended Dr Cao’s death. The other is that the sentence which I imposed upon him accorded with the punishment which the Director submitted was appropriate. An appreciation of these facts is fundamental to an understanding of the Caratozzolo sentence.

澳洲看来不光是瘾君子的天堂原来也是杀人犯的庇护所啊..
